- CLAUSE 1 - PRICES
The prices of our products appear with all taxes included in Swiss francs or euros at the rate of (1euro ~ 1.50CHF). Kinoflex.com reserves the right to modify its prices at any time. The products will always be invoiced based on the current prices at the time of processing the order.
- CLAUSE 2 - SHIPPING/ DELIVERY/ EXCHANGE
The ordered products are shipped to the delivery address which you indicated during the ordering process or the one which is on your profile on the web site. The products are shipped after reception of the order and its payment. In the event of unusual delay, due to an out-of-stock condition for example, we will send you an email to inform you.
We guarantee to exchange the products not corresponding to your order (defective or does not conform). For reasons related to royalty rights, no unpacked product will be accepted without our prior written confirmation; except in cases of exchanges with the exceptional return right "Xchange".
The shipping time is 2 to 5 days, except for special notice (Pre ordering, out-of-stock).
Shipping costs are free for orders exceeding 75.-CHF (50.-EUR). For orders not exceeding this amount, they are fixed at 5.-CHF for Switzerland and 7.50CHF (5.-Euro) for the other European countries.
Return rights
Products benefiting from a right to return "Xchange" can be returned before the expiration date shown on the order slip of this product (The postmark date is your proof). After this date, the right to return expires.
The day of the delivery is considered as the beginning countdown date for the right to return and not the day that the product was ordered.
The expenses of return are the responsibility of the customer.
After the return of a product, Re-storage expenses are applied at a rate of 40% of the product's value at the time of purchase. The customer will receive a good of purchase or coupon for the (60%) balance which he/she can apply to any purchase on Kinoflex.com . No other refund method can be claimed.
The right to a refund can be denied in the following cases:
-The expiration date for the right to return has been largely exceeded.
-Loss of a product during it's return from the customer to Kinoflex.com
-The disc, its case and possibly the documents or accessories necessary to the use of the video game were damaged by a non recommended use and/or are missing in the return packing.
-The disc, its case and possibly documents or accessories necessary to the use of the video game present an inscription or engraving or not the original label.
- CLAUSE 3 - RESPONSIBILITY
The offered products are in conformity with the current Swiss legislation. Kinoflex.com is not responsible for eventual errors of illustrations or product description.
Kinoflex.com will not be held responsible for failure to execute the contract in the event of unavailability or out-of-stock conditions of the product, of disturbance or partial or all-out strike, in particular of the mail service and means of transport and/or communications, technical problem on the server of the hosting company , supervening of any anomaly or defect of the supplier of Internet access, traffic interruption of by the telecommunication operator , computer and video and audio hi-fi equipment or of the customer's configuration, and of all acts of god such as (flood, set fire to etc...)

- CLAUSE 4- PERSONAL INFORMATION
Kinoflex.com is committed not to reveal with any others information that you communicate to us. Those are confidential. They will be used by its internal services only for the processing of your orders. Consequently, in accordance with the law, you have a right of access, of correction, and of opposition to your personal data.
All your data is encrypted by a secure server and your personal data as well as your credit card numbers are thus not apparent.
The access to the website www.kinoflex.com is done by a user name and password chosen by the subscriber and under his whole responsibility. This code is personal, confidential and non-transferrable to any other person, it identifies the subscriber as such. Kinoflex.com at it's own discretion and by informing the subscriber, will be able to modify, change, delete a password and/or a user name for a new one at any time;
The subscriber explicitly agrees that the use of his user name and password expresses his full consent and agreement to all operations and transactions initiated , with all the factual and lawful consequences which may arise.
- CLAUSE 5 - APPLICABLE LAW - LITIGATIONS
This contract is subjected to the Swiss law. Any litigation between the parts will be regulated exclusively in front of the Courts of Nyon in the Canton of Vaud in SWITZERLAND.
This clause determines jurisdiction. In no case will the place or method of payment be able to invalidate the present clause
